Terms of Service

Welcome to Qiyam. By downloading or using the Qiyam iOS application, you agree to these terms. Please read them carefully.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the Qiyam iOS app ("App"). If you do not agree to these Terms, do not install or use the App.

2. Use of the App

Qiyam is provided for personal, non-commercial use. You agree to:

• Use the App only for its intended purpose of Fajr prayer wake-up and accountability
• Not attempt to reverse engineer, decompile, or tamper with the App
• Not use the App in any way that violates applicable laws or regulations
• Not use the Fajr Partner or accountability features to harass, threaten, or harm others

3. Free Features

The following core features are free and always will be:

• Accurate prayer time calculation
• Barcode Scan alarm dismiss method
• Daily Fajr check-in and log
• Streak tracking and history
• Qiyam Coach accountability feature
• Fajr Partner matching (invitations)

4. Pro Subscription

Qiyam offers an optional Pro subscription that unlocks additional features. Subscription terms:

• Free trial: A 7-day free trial is available for new Pro subscribers
• Pricing: Pro Annual is $39.99/year. Pricing may vary by region as displayed in the App Store.
• Billing: Subscriptions are billed through Apple's App Store. Your Apple ID account is charged at confirmation of purchase, or after any free trial period ends.
• Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• Cancellation: You can cancel at any time through iOS Settings → [Your Name] → Subscriptions → Qiyam. Cancellation takes effect at the end of the current paid period; no partial refunds are provided.
• Refunds: Refund requests are handled by Apple. Contact Apple Support or visit reportaproblem.apple.com

5. Prayer Time Accuracy

Qiyam calculates prayer times using GPS coordinates and standard Islamic calculation methods (ISNA, MWL, Umm al-Qura). While we strive for accuracy, prayer times are estimates based on astronomical calculations and may differ from times published by your local mosque or Islamic authority. Always verify prayer times with your local Islamic resource, especially during travel or in regions with unusual sunrise/sunset patterns.

Qiyam is a productivity and accountability tool. It is not a fatwa-issuing authority.

6. Accountability Features Disclaimer

The Qiyam Coach, Fajr Partner, and Fajr Circle features are motivational tools. They do not guarantee that you will wake up for Fajr or that your prayer will be accepted. We are not responsible for missed prayers, missed alarms, or any spiritual outcomes. The accountability features communicate via local device notifications only.

7. Partner Features

When you use the Fajr Partner matching feature, you may be paired with another Qiyam user. By using this feature, you agree to:

• Treat your partner with respect and Islamic etiquette (adab)
• Not share your partner's information with third parties
• Not use messaging for spam, harassment, or off-topic commercial promotion
• Report misuse to buddies@getqiyam.com

We reserve the right to remove users who violate these community standards.

8. Intellectual Property

All content, design, source code, graphics, and branding in the Qiyam App are owned by us or licensed to us. You may not reproduce, distribute, or create derivative works without prior written permission.

9. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, accuracy of prayer times, or uninterrupted service. We do not warrant that the App will be error-free or that alarms will fire in all circumstances (iOS system restrictions, Do Not Disturb, battery saver, or other configurations may affect alarm delivery).

10. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including missed prayers, missed alarms, or data loss. Our total liability shall not exceed the amount you paid for the App in the past twelve months.

11. Changes to the App and Terms

We may update the App and these Terms from time to time. Material changes will be communicated via an in-app notice or an updated "Last updated" date. Continued use of the App after changes constitutes acceptance of the updated Terms.

12. Termination

We reserve the right to discontinue the App or restrict access at any time. You may stop using the App and uninstall it at any time.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which the developer is located. Any disputes shall be resolved through binding arbitration or the courts of that jurisdiction.
